š° Publication Use License (Extended / Case-by-Case)
1. Definition
āPublication Useā refers to any use of images or media in materials or outlets intended for mass distribution or editorial publication, whether in print or digital form. This includes, but is not limited to:
- Print and digital magazines, newspapers, and articles
- Books, eBooks, and printed publications
- Billboards, posters, and public advertisements
- Paid or sponsored digital advertising campaigns
- Television, film, and video productions
- Product packaging, branding, or merchandise
- Any use connected to commercial resale, redistribution, or promotional materials distributed to the public beyond standard real-estate marketing
2. Approval Required
All Publication Use requires written approval and a separate signed Publication License Agreement prior to use.

Each Publication License will be priced and reviewed on a case-by-case basis, depending on the nature, reach, and distribution of the project.
3. Exclusivity
Publication Licenses are non-exclusive by default.
Exclusivity may be considered on a case-by-case basis and must be explicitly granted in writing.
If exclusivity is later sold to another licensee, all prior license holders retain their existing perpetual usage rights under their original terms.
4. Attribution
All Publication Uses must include visible or written credit in one of the following formats:

or
āImage courtesy of ScenicStock.comā
Attribution should appear in the photo caption, credit page, or other appropriate acknowledgment area within the publication.
5. Duration
Publication Licenses are perpetual for the specific approved use (e.g., a single article, ad campaign, or printed edition).
Any reuse, reprinting, or redistribution in new editions, platforms, or campaigns requires a new license approval.
6. Print Run Limits
For regional publications and advertising campaigns based in Bend, Oregon or comparable markets, a single approved publication use typically covers up to 10,000 physical copies or impressions.
Projects exceeding that threshold (e.g., national print runs, syndication, or digital ad reach beyond 100,000 impressions) will require a revised or extended license agreement.
7. Restrictions
Unless specifically authorized in writing, Publication License holders may not:
- Resell, sublicense, or distribute images for resale in any form
- Repurpose images for merchandise, print-on-demand products, or resale goods
- Use images in logos, trademarks, or brand marks
- Use images in a way that implies endorsement by the photographer or ScenicStock
- Use images in politically or socially sensitive content without disclosure and approval
- Use images in AI datasets, machine learning systems, or NFTs
8. File Delivery
Upon approval, high-resolution or print-ready versions of the images may be provided if available.
ScenicStock will work with you to ensure all files meet publication and print standards.
9. Agreement
All Publication Licenses require a signed individual Contract Agreement issued by ScenicStock or Jackson Real Estate Photography Co.
Standard real estate and business branding uses do not require a separate contract but do require acknowledgment of the siteās Terms and Conditions at checkout.
