📸 Image Licensing Terms & Conditions

By purchasing or downloading any image from ScenicStock or Jackson Real Estate Photography Co., you agree to the following license terms. All licenses are non-exclusive and perpetual unless otherwise stated.

📸 Standard Use License (Included with Purchase)

The Standard Use License grants non-exclusive, perpetual usage rights for general marketing and promotional use by the purchaser.
Copyright is not transferred.

1) Copyright & Ownership

  • All copyrights remain with the original photographer and/or ScenicStock.
  • Your purchase grants usage rights only; no ownership or authorship is transferred.

2) Permitted Uses (Scope)

  • Real estate listings (MLS, Redfin, Zillow, etc.).
  • Websites, social media, email, and online ads promoting your business.
  • Printed brochures, flyers, postcards, and signage.
  • General business branding and promotional materials.
  • Local and regional marketing campaigns.

3) File Usage & Storage

  • Files may be stored and backed up internally by the purchaser for their own use.
  • No sharing with outside parties (agents, brokerages, designers, contractors, or vendors) unless they are working on your project under your direction and agree to these terms.
  • Do not upload or redistribute files to stock libraries, public drives, or any platform for third-party download.

4) Edits & Modifications

  • Allowed: basic adjustments such as crop, resize, straightening, exposure, white balance, contrast, and minor retouching for clarity.
  • Not allowed: significant alterations that change original content (e.g., adding/removing property features, misleading sky swaps, deleting signage/brand marks, heavy compositing).
  • No AI or derivative generation: you may not create AI videos/animations, train models, generate synthetic media, or produce derivative works via generative systems.

5) Branding & Resale Restrictions

  • Images may not be used in logos, trademarks, or service marks.
  • Images may not be resold, sublicensed, or distributed as standalone files, NFTs, or stock assets.
  • Do not claim authorship or copyright over the image.

6) Liability & Misuse

  • The purchaser is responsible for compliant use of the images.
  • ScenicStock and the photographer are not liable for misuse, misrepresentation, or any violation of third-party rights.

7) Acceptance of Terms

  • Completing checkout constitutes your acknowledgment and acceptance of these Standard Use terms.

đź“° Publication Use License (Extended / Case-by-Case)

The Publication License covers usage that goes beyond typical marketing — such as editorial, mass distribution, or commercial resale — and is not included with your image purchase.

1) Definition

“Publication Use” refers to any use of images or media in materials or outlets intended for mass distribution or editorial publication, whether in print or digital form. This includes, but is not limited to:

  • Magazines, newspapers, and editorial articles (print or online).
  • Books, eBooks, and printed publications.
  • Billboards, posters, and public advertisements.
  • Television, film, and video productions.
  • Product packaging, branding, or merchandise.
  • Paid or sponsored digital campaigns or resale products.

2) Approval Required

  • All Publication Use requires written approval and a separate signed Publication License Agreement prior to use.
  • Contact hi@jacksonrep.co to request permission and obtain pricing.
  • Each request is reviewed and priced on a case-by-case basis depending on reach and distribution.

3) Exclusivity

  • Publication Licenses are non-exclusive by default.
  • Exclusive rights may be granted on a case-by-case basis and must be stated in writing.
  • If exclusivity is later sold to another licensee, all prior holders retain their existing perpetual usage rights.

4) Attribution

  • All Publication Use must include visible or written credit in one of the following formats:
    • “Photo © [Photographer Name] / ScenicStock”
    • “Image courtesy of ScenicStock.com”
  • Credit should appear in the photo caption, credit page, or acknowledgment section of the publication.

5) Duration

  • Publication Licenses are perpetual for the specific approved use (e.g., one article, ad campaign, or printed edition).
  • Any reuse or redistribution in new editions, platforms, or campaigns requires new written approval.

6) Print Run & Distribution

  • For regional publications or Bend, Oregon–based campaigns, the standard limit is 10,000 physical copies or impressions.
  • Projects exceeding that threshold (e.g., national print runs or digital reach beyond 100,000 impressions) require a revised or extended license.

7) Restrictions

  • Unless specifically authorized in writing, Publication License holders may not:
    • Resell, sublicense, or distribute images for resale in any form.
    • Repurpose images for merchandise or print-on-demand goods.
    • Use images in logos, trademarks, or brand marks.
    • Use images in a way that implies endorsement by the photographer or ScenicStock.
    • Use images in politically or socially sensitive content without disclosure and approval.
    • Use images in AI datasets, machine learning systems, or generate derivative videos/animations.

8) File Delivery

  • Upon approval, ScenicStock may provide high-resolution or print-ready versions of the images if available.
  • We will work with you to ensure all files meet publication and print standards.

9) Agreement Requirement

  • All Publication Licenses require a signed agreement issued by ScenicStock or Jackson Real Estate Photography Co.
  • Standard marketing and business uses do not require a separate contract but do require acknowledgment of these Terms at checkout.

Summary:
